Marriage Notification in Ireland with Foreign Documents

Certified translation guide · Family & Civil Status

The HSE marriage notification is where foreign birth certificates, divorce decrees and translations meet. Here is what the registrar asks for, when an apostille is needed, how foreign divorces are recognised and why you should start early.

Every marriage in Ireland, civil, religious or secular, starts with the same appointment: the marriage notification with a registrar of the HSE Civil Registration Service. For an Irish couple it is mostly a formality. For a couple where one or both partners were born, married before or divorced abroad, it is where foreign documents, translations and apostilles all come into play at once. This guide walks through what the HSE and Citizens Information say, and where translations fit.

Guide

The basics: three months and a Marriage Registration Form

Irish law requires at least three months' notice. The HSE explains that you give that notice at a marriage notification appointment, and that "The 3 months' notice starts from the marriage notification appointment date." If everything is in order, the registrar issues a Marriage Registration Form (MRF), sometimes called a marriage licence, which is valid for six months from the intended date of the marriage. The notification fee is €200 and is non-refundable (HSE, How to get married in Ireland).

The HSE's advice on timing is worth repeating: waiting times vary, so book as soon as you can rather than close to the three-month mark. If foreign documents need translating or apostilling, build that time in before the appointment, not after.

What to bring, and the translation rule

The HSE checklist asks each partner for photo ID with a photocopy of the photo page, the original and a photocopy of their birth certificate, proof of address dated within the last three months, and their PPS number. Then comes the line that matters for foreign documents:

If your documents are not in English or Irish you must provide translations.
HSE, Marriage notification appointment checklist

The checklist does not spell out the form of translation. Elsewhere, for foreign marriage certificates presented at a birth registration, the HSE says a translation "must be from a certified translation service" and that it can accept "the multilingual form (a form in English and another language) available from most embassies or registration services" (HSE, Register a birth). A certified translation from a professional translator is the safe standard to bring to a notification appointment too. See our certified translation guide for what it must contain.

Birth certificates and apostilles

Citizens Information sets out when a foreign birth certificate needs an apostille:

If your birth certificate was issued in a country outside the EU it may need an apostille or legalisation to certify that it is authentic.
Citizens Information, Notification requirements for marriage

It adds that since 16 February 2019, a birth certificate issued in another EU member state "no longer needs an apostille or authentication", and advises checking with your local civil registration service to find out exactly what is required. The apostille goes on the original certificate in the country that issued it; the translation is then made of the apostilled document. For Hague Convention countries, we can arrange apostille certification of the source document alongside the birth certificate translation.

If your birth certificate comes from an EU country, ask the issuing office for an EU multilingual standard form. The HSE already accepts the multilingual form for foreign marriage certificates at birth registration, so ask your registrar whether it will accept one for your notification; if it does, you may not need a translation at all. The EU multilingual forms guide explains how they work.

Freedom to marry: what the registrar actually asks

Many couples arrive expecting to need a "certificate of freedom to marry" from their home country. Irish civil registration works differently. Citizens Information explains that at the appointment both partners sign, in the registrar's presence, "a declaration that you are free to marry and know of no lawful impediment to your proposed marriage." Your freedom to marry is shown by that declaration plus the documents that prove your civil status: a divorce decree if you are divorced, a death certificate and marriage certificate if you are widowed, a dissolution decree if you had a civil partnership.

The HSE checklist does not list a separate certificate of no impediment for foreign nationals. If a registrar asks you for a civil status certificate from your home country, it is a civil document like any other and needs a translation if it is not in English or Irish. Our certificate of single status page covers these documents by country.

Irish citizens marrying abroad

The reverse situation is common too. Some countries require an Irish citizen to produce a Certificate of Freedom to Marry, which the DFA issues and which is "also known as a Civil Letter of Freedom, Certificate de Coutume or Nulla Osta." The DFA asks for "certified translations of any of these documents, if the originals are in a language other than English or Irish" for the supporting documents, and asks you to apply at least four months before the date of the marriage (DFA, Marriage and civil partnership abroad).

Guide

If you were divorced abroad

This is the part of the process that takes longest, so it deserves attention early. The HSE checklist asks for "an original or certified copy, and photocopy, of your divorce decree" and adds: "Contact the civil registration service for advice if you divorced in another country."

The reason is recognition. Citizens Information explains that "Not all foreign divorces are recognised under Irish law." In outline:

Where EU rules do not apply, you complete a questionnaire from the registrar, and the information goes to the General Register Office, whose consent is needed before the marriage can take place. If the General Registrar is not satisfied, you can supply more information or apply to the Circuit Court (Citizens Information, Legal requirements for marriage).

For translations, this means a foreign divorce decree should be translated in full, including the parts that show where the parties lived, when the proceedings began and when the decree became final. Those details are exactly what a recognition decision turns on. See our divorce documents translation page.

Interpreters at the appointment and the ceremony

Translation is not only about paper. The HSE says the registrar's interview is held in English or Irish, and if you want to speak another language you must provide an interpreter, at the interview and at the ceremony:

Interpreters must be from an independent verifiable translation or interpretation service.
HSE, Marriage notification appointment checklist

Citizens Information adds that the interpreter must be present for both the notification and the marriage itself. A friend or relative who speaks both languages is unlikely to meet the "independent" test.

Facts worth knowing

The notification fee is €200, non-refundable. Same-sex couples already in an Irish-registered civil partnership pay a reduced fee of €50.

The Marriage Registration Form is valid for six months from the intended date of the marriage.

After a religious or secular ceremony, the MRF must be given to a registrar within one month to register the marriage.

Under the Civil Registration Act 2004, as amended in 2014, a registrar can investigate a suspected marriage of convenience and refer it to a Superintendent Registrar.

Since 16 February 2019, birth certificates from other EU member states no longer need an apostille for a marriage notification.

FAQs

Common Questions

Do foreign documents need translating for a marriage notification in Ireland?+
Yes. The HSE checklist says that if your documents are not in English or Irish you must provide translations. A certified translation from a professional translator is the safe standard, and the HSE also accepts EU multilingual forms.
Does my foreign birth certificate need an apostille to marry in Ireland?+
Citizens Information says a birth certificate issued outside the EU may need an apostille or legalisation. Since 16 February 2019, birth certificates from other EU member states no longer need one. Check with your local civil registration service for your case.
Do I need a certificate of freedom to marry to marry in Ireland?+
The HSE checklist does not list one. Both partners sign a declaration before the registrar that they are free to marry, supported by documents such as a divorce decree or a late spouse's death certificate. If a registrar asks for a civil status certificate, it needs translating if it is not in English or Irish.
What happens if I was divorced outside Ireland?+
